Establishment (Foundation) of a firm by a Foreign National Natural Person
Merchant is a person who even partially (or completely) operates a commercial entity in its name and on its behalf. (Turkish Commercial Code, Article 12).
Commercial title of natural person merchant is formed by stating the merchant’s full name and surname without abbreviation. Appropriate addition(s) may be made to name and surname in conformity with 46th article of Turkish Commercial Code.
Plural suffixes, names of other persons and foreign words should not be used in the commercial title as if it is reminding of a partnership.
If the foreign national will operate his/her firm by himself/herself actually, it is required to obtain a work permit from the Ministry of Labor and Social Security General Directorate of Labor upon application.
Registration Procedures (Transactions)
(1-) Petition (must be signed by the merchant)
(2-) Attestation of commercial title prepared in the Notary Public, (and should include, resident and office address, field of activity, starting date of business, nationality, TR Identity number of the merchant (if the merchant is a foreign national, tax number obtained from tax office, his/her commercial title and 3 specimen signatures under the commercial title),
(3-) Passport copy (translated into Turkish and notarized (2 copies) and tax number list
(4-) Chamber Registration Statement, (must be signed by the officials and must be with photos of the partners/shareholders,
If the merchant is a TR citizen residing abroad, work or residence permit must be attached. (in authenticated form). If the merchant is a foreign national residing in Turkey, residence permit must be submitted. (in authenticated form)
